How to get a Spanish NIE from the USA without travelling

You may need a Spanish NIE before you ever land in Spain — to buy property, sign bank paperwork, prepare an inheritance or organise a relocation file. Here are the two remote routes US clients normally consider, and the documents that make them work.

Ask about a remote NIE

A Spanish NIE is just an identification number, but in practice it unlocks many formal steps in Spain. A notary may need it before a property deed is signed. A bank may ask for it before opening an account. A tax office may need it before a non-resident filing, inheritance or company appointment can move forward. For US clients, the obvious question is practical: can the NIE be obtained while you are still in the United States, or do you have to fly to Spain for a police appointment?

The answer is that a remote NIE is often possible, but not automatic. You must choose the right route, document a real reason for the number, and avoid confusing the NIE with later residence steps. The two main paths are applying at the Spanish consulate that covers your US residence, or appointing a representative in Spain to apply for you with proper authority.

When a remote NIE makes sense

A remote NIE is most useful when the number is needed for a Spanish act that can start before arrival. Typical examples include a US buyer reserving a property in Malaga or Marbella; a retired couple preparing a non-lucrative visa file; an American heir who must appear in a Spanish inheritance deed; a founder appointed as director of a Spanish company; or a family opening early bank and tax records before moving.

What the remote NIE does not do is give you permission to live in Spain. The NIE is a number. The visa or residence authorisation is a separate legal status, and the TIE is the physical card non-EU residents normally obtain after arrival. A remote NIE can prepare the file; it does not replace the immigration route.

Key distinction: NIE = number. Visa/residence = permission to live. TIE = residence card. A remote NIE can be useful before travel, but it is not a residence permit.

Route 1: applying through a Spanish consulate in the US

Spanish consulates in the United States usually allow residents of their consular district to request a NIE before travelling. The exact mechanics vary by post: some consulates require an appointment, some accept certain document submissions by mail or in narrow walk-in windows, and payment methods can differ. You should follow the instructions of the specific consulate that covers your residence, not a random checklist from another city.

The core file is normally familiar: EX-15 application form, passport and copy, a written explanation or evidence of the economic, professional or social reason for the request, and the applicable consular fee or 790-012-related payment method. If the application is accepted, the consulate forwards the request through the Spanish system and the NIE certificate is later issued or communicated.

This route is clean because you remain the direct applicant and avoid granting a power of attorney. The bottleneck is availability and processing time. If a property signing or inheritance deadline is close, a consular route that looks simple on paper can still be too slow.

Route 2: authorising a representative in Spain

The second route is to authorise a representative — usually your Spanish lawyer — to apply for the NIE in Spain. This can be useful when the Spanish file is already being handled by counsel, or when timing in Spain is more manageable than the consular route. The representative will need authority to act, and that authority must be acceptable to the Spanish office handling the request.

For a US client, the authority usually takes one of two forms. The cleanest is a Spanish power of attorney signed before a Spanish consulate, because it is already a Spanish public document. The alternative is a power of attorney signed before a US notary, legalised with a Hague Apostille, and translated into Spanish by a sworn translator if it is not already bilingual. The wording should expressly authorise the representative to request, collect and use the NIE certificate.

A representative route does not remove the need for a justified reason. The office still wants to understand why the foreigner needs a NIE. A well-prepared file therefore pairs the power of attorney with the underlying evidence: property reservation, inheritance file, company documents, bank requirement, tax need or similar.

The remote file should be built around the standard NIE application logic. Requirements can vary by consulate and province, but the recurring documents are:

Small inconsistencies cause outsized delays. Your name, passport number, address and signature should match across the EX-15, passport, power of attorney and supporting documents. If your US documents use a middle name or suffix, carry that through deliberately rather than leaving each document to a different convention.

The reason: why Spain asks for a motivo

Spanish authorities do not issue a NIE simply because someone is curious or may one day do something in Spain. The request must explain economic, professional or social grounds. In practice, this means the file needs a concrete reason: buying a named property, accepting a Spanish inheritance, being appointed director of a Spanish company, opening a bank account for a documented transaction, or handling a tax obligation.

For US relocation clients, the strongest files are specific. "I am moving to Spain soon" is weaker than "I need the NIE to sign a lease, open a bank account and prepare a non-lucrative visa-related relocation file." "I might buy property" is weaker than a reservation contract or lawyer's letter tied to an actual transaction. A representative can help frame the reason, but the underlying facts must be real.

Most remote NIE problems are not about the number itself. They are about a vague reason, an incomplete authority, or documents that do not match each other.

Timing, fees and limits

Timing depends heavily on the route. Consular processing can be convenient but appointment and turnaround times vary by US post. A representative route depends on appointment availability and practice in the Spanish province where the application is filed. Neither route should be left until the week before a notarial signing if the NIE is essential to the transaction.

Fees are modest at the official level but differ in format: some consulates publish a dollar fee and payment method; Spanish offices commonly use the 790-012 fee form. If a power of attorney is needed, add notary, apostille and sworn translation costs. Those are not government NIE fees, but they are part of the remote-file budget.

The biggest limit is status. A NIE certificate issued remotely does not skip later in-person immigration obligations. A non-lucrative visa holder, for example, still needs to enter Spain and complete the TIE fingerprint/card process within the applicable timeline. The remote NIE is a setup tool, not a full relocation process.
